I would fix the clutch first and see if this improves things. If it creeps this is why it wont select neutral. The clutch basket can wear out as well as the clutch plates
I would check for an intake leak one way to do so would be to wait till the bike was cool and i say this because if it is hot it is dangerous and spray some ether or starter fluid on the air intake and if the bike dies it has a leak this happened to me and it was a quick fix after i found the leak gaskets are cheap that is! Check brake light switch behind brake pedal remote start has to be wired into switch so vehicle will shut down when brake is depressed when put into gear without ignition switch turned on. possible bad connection on switch or wires are not attached.
There could be several problems here. One problem could be the way you're shifting the gears. I've been riding for over 40 years and I still miss a gear every now and then due to sloppy shifiting.
If you don't think this might be the problem, you may want to check your clutch adjustment to make sure the clutch is disengaging. The easy way to tell this is to put the transmission in low gear, the start the bike with the lever held in. Does the bike lurch forward or have a strong tendency to "pull" the bike with the clutch completely pulled? If so, adjust the clutch mechanism.
Next, your shifter pawl may be getting ready to give up the ghost. These year model Sporty's are notorious for shifter pawl carrier failure. They are not difficult to replace for someone with a good basic mechanical ability.
Wow, valves and other related engine noises don't care what gear you are in, they still make the noise. However your motor may be "lugging" in 5th gear which can cause a symptom of an engine related issue. You may have an issue with the actual gearbox its self. There is a primary drive chain that may be worn which will cause excessive noise in top gear because it is putting the greatest load on the engine. This is what connects the engine to the transmission. I think there is a tensioner for your model that will allow you to adjust the free play in the primary drive chain. If not I strongly recommend replacement because this will cause major damage if it breaks.
