First of all, you should stop saving any new files to your Nokia n70 cell phone (or SD card) or taking new pictures.

Then find some photo recovery software, which are able to recover deleted or formatted photos and movies from cell phone, digital camera, memory card and SD card etc.

Digital Photo Recovery for Windows

Digital Photo Recovery for Mac OS X

Here are the steps:

Step 1: Download and install the Digital Photo Recovery Software.

Step 2: Connect your Nokia n70 cell phone (or SD card, memory card etc) to your PC or Mac.

Step 3: Scan the source drive where your lost pictures located.

Step 4: Recover the lost pictures and save them to another drive instead of the source drive.

Best regards!

If a file has actually been "overwritten" and not just "deleted" then no your photos are toast. Had they been deleted you may of had a chance. However you might want to attempt to use a program such as Tenorshare Data Recovery and try and restore deleted photos . I doubt it will find anything that is actually recover able but it never hurts to try.

I have test it in many times, such as restore samsung galaxy s2, recover samsung galaxy s3, recover data from memory stick ect.

While the photos were deleted from mobile phone, they are not deleted permanently. You can still get them back from the memory card with memory card recovery software. I advise you to use Card Data Recovery. It is a nice photo recovery program that can help you recover photos from all popular mobile phone memory cards. It has two versions separately designed for Windows and Mac users. To see more detailed information about it, you can refer to its official website:
Card Data Recovery for Windows(for Windows users)
Card Data Recovery for Mac(for Mac users)

DO NOT Panic. There is a chance that you will be able to get back some or all of your deleted digital photos, provided those deleted photos were saved on the external memory(card or stick) of your N 70 phone.

First things first: DO NOT take any more pictures with the memory card that you want to recover photos from.

Quick Internet searches will reveal a tremendous number of programs, find this one called Wondershare Photo Recovery is quite nice with both Windows and Mac versions provided. It should help you. Download the program here,
Photo Recovery (for Windows)
Mac Photo Recovery (for Mac OS X)

How to perform photo recovery?

Take the memory card from the phone (powered off) and connecte with your computer with such photo recovery software installed. Then follow the recovery steps instructed by the progrm, best regards.

Don't worry! Nowadays, deleting some important photos is not a big deal since you can easily retrieve these deleted photos back from your call phone as long as they are not overwritten by anything new on the same phone sine then.
What you need is simply a proper deleted photo recovery freeware that can deeply scan your phone memory card and do its utmost to get back your deleted photos as many as possible:
http://blog4mark.blogspot.com/2012/12/photo-recovery-after-delete.html
It has offered you four data recovery options for you to recover your wanted photos back, such as "Deep Scan Recovery", "Advanced File Recovery" and "Format Recovery", etc. In your case, the former two can be good choices for you.
Just download this photo recovery freeware here:
http://www.freeware-fix.blogspot.com/2013/02/photo-recovery.html

Good luck!

This software scans all storage space on usb and then join pieces together to recover photos. So even virus affected your file table, and put virus to boot sector, the program can still be used to recover your photos.
